Les données personnelles sont nécessaires pour permettre aux administrateurs d'identifier les utilisateurs qui insèrent leurs données dans les archives et en aucun cas pour être distribués.

L'adresse email peut être consultée de manière indirecte par le comité de validation pour prendre contact avec les observateurs pour obtenir des compléments d'informations, ou par les autres utilisateurs d'ornitho.it pour l'échange directe d'information.
 
Le comité de pilotage, par l'intermédiaire des administrateurs techniques d'ornitho.it, a le pouvoir de bloquer l'enregistrement d'un utilisateur à tout moment en cas de violation des régles (voir page correspondante).

1. Goals

 

Ornitho.it has the following institutive goals:

 

  • Building and maintaining a homogenous ornithological database for the entire territory of Italy, San Marino, the Holy See, and northern Tunisia
  • Creating a useful knowledge base for the conservation of Italy’s ornithological heritage
  • Monitoring Italy’s avian wealth, with particular regards to protected areas and Natura 2000 network sites
  • Sharing basic ornithological information

 

Ornitho.it’s registered users agree to this initiative, and offer their contribution to Ornitho.it’s institutive goals on a non-profit basis.

Registered users undertake to contribute to Ornitho.it within a framework of shared participation, with the primary goal of improving ornithological knowledge and avian conservation in Italy.

 

2. Registration and ownership of data

Registration in Ornitho.it is available to all free of charge. Data can be entered only by observers who are registered users of Ornitho.it. There is no limit to the quantity of data that can be entered by individual registered users. Individual registered users have exclusive responsibility over the reliability of the data they enter.

Data are the property of individual registered users, who are free to make them available, free of charge, to the national associations – and, for specific geographic areas, the regional associations – which contribute financially to Ornitho.it (see article 5), through a declaration to be made by compiling an electronic form upon applying for registration (see article 3.1.). The geographical areas (regions) that fall within the competence of the individual regional associations are listed in the electronic form. This declaration can be modified at any time by individual registered users through their own personal site. There are also provisions for making the data freely available to specific projects (e.g. national breeding and wintering bird atlases), on the basis of specific indications provided by the Steering Group.

 

At any time, registered users can access, cancel, or correct all their entered data (within 30 days of entry; after that, the cancellation or correction of a datum must be authorized by the Data Verification Group). With the exception of data classified as “restricted”, which applies to species for which it would be best not to disclose information accompanied by details that may hinder their conservation (a list of species for which data will be automatically classified as “restricted” will be provided by the Steering Group), which will not be visible and whose use must be authorized by the relevant observers, individual registered users allow “authorized registered users” (see article 3.1.) to freely consult and use the data obtained by querying the database.

The data in Ornitho.it’s archive have no commercial value and cannot be sold in any way.


3. Data consultation and use

 

At all times, each registered user is entitled to make full use of his or her data.

The norms listed below regulate the consultation of data entered by other registered users.

 

3.1. Non-restricted data

 

All non-restricted data are freely available for consultation by registered users within 30 days of the data being entered. Only registered users who have inserted an average of at least 100 data points/month (“authorized registered users”) are allowed to query the database with regards to individual data points entered in the previous 30 days.

All registered users can freely query the database for aggregate data (search functions: “list of species”, “summary”, “long-term trends”, “altitudinal distribution”, “satellite photo”). Such data can be used by Ornitho.it’s partner associations (see article 5) and by individual registered users for information and comparison purposes, providing the source is correctly cited. We suggest the following citation: information drawn from www.ornitho.it, consulted on [date]. 

Ornitho.it’s partner associations, through their legal representative or delegate thereof, shall be entitled to use the data entered by a given member only and exclusively if expressly authorized by said member (see article 1).

 

Associations and individual authorized registered users can also request to consult the entire database in order to obtain geo-referenced data on single species or specific geographical areas. Any request to use data in the database on the part of associations or individuals must be approved by the Steering Group, following submittal of a brief project proposal (maximum 250 words). Projects will be evaluated on the basis of the project itself and the scientific credentials of the proposer. In case of disagreement between the members of the Steering Group, projects will be approved on a simple majority basis (for voting rules see article 5). The Steering Group undertakes to approve or reject each request for data use within 30 days of receipt, and to provide the basis for its decisions. The project proposal, along with the proposer’s CV, must be sent to the Steering Group’s email address. Projects approved by the Steering Group shall be made public in an ad hoc section of the site.

The members of the Steering Group and Data Verification Group do not enjoy any rights to use the data additional to those of other users. The use of the database on the part of these persons is subject to the rules listed above.

Once data is used, its individual owners must be guaranteed visibility and acknowledged. Each data point must explicitly cite the first and last name of the relevant observer (example: Mario Rossi in www.ornitho.it, consulted on …)

 3.2. Restricted data

 

The use of data classified as “restricted” when entered (see article 2) is always subject to consent on the part of the relevant individual registered user. The list of species automatically excluded from public visibility for conservation reasons is established by the Steering Group, with the help of local specialists if necessary. This list is published on the website.


4. Data verification


Data quality is ensured by the Data Verification Group (see article 7). When needed, the Group’s members ask the observer for additional information for a given data point, which is kept separate from the archive until it is either confirmed or corrected. Verification of restricted species is entrusted to a small group of reviewers (no more than 7) with proven reliability and expertise with the relevant species, who formally undertake to guarantee maximum confidentiality in handling said data. Reports of vagrants or first breeding records for Italy are automatically forwarded to the Italian Records Committee (Commissione Ornitologica Italiana - COI).


5. Composition, functioning, and renewal of the Steering Group


The Steering Group ensures the management of Ornitho.it, guides its decisions, nominates the Data Verification Group, and evaluates, approves, or rejects requests to use the data present in the archives. Individuals appointed to the Steering Group, regardless of their affiliation, undertake to work in the best interests of Ornitho.it, in pursuit of its objectives, and in favour of its development within the Italian ornithological community.


The Steering Group serves a three-year term and is comprised of one representative from each of the 3 nationally-recognized ornithological and birdwatching associations (CISO, EBN Italia, LIPU); 1 representative from ISPRA; Ornitho.it’s administrator (on behalf of Vogelwarte Sempach); 4 representatives from regional associations (no more than one representative per associations), attempting to maintain as broad a geographic representation as possible (north, centre, south, and islands). Any changes in the Steering Group must be approved unanimously.

 

During meetings of the Steering Group, the administrator shall serve as chairperson.


The Steering Group can co-opt representatives of nationwide ornithological projects, in cases where this can foster improved collaboration and sharing of data.


The Steering Group’s decisions shall be taken on a majority basis, excluding abstaining voters. The Steering Group’s decisions are final.

Steering Group votes can take place electronically (via e-mail). In cases in which the necessary quorum is not reached for a given vote, the motion shall not be approved. In case of a tie, the administrator’s vote counts double.

All members of the Steering Group have voting rights.

Every three years, the respective national associations shall appoint or confirm their representative.

At the end of the Steering Group’s term, the administrator calls upon the associations that contribute financially to Ornitho.it to appoint, within 30 days, the Steering Group’s members for the next three-year term. The legal representatives of each of the four national associations are in charge of nominating their respective registered users.

The list of the names of the four representatives of the national associations must be underwritten by the legal representatives of these associations. Posts for which representatives have not been nominated within the established deadline shall remain vacant for the entire duration of the three-year term.

Confirmation or revocation of the administrator shall be mutually agreed upon by the owner of the software and the Steering Group. The Steering Group, after a decision taken by absolute majority, shall submit a proposal to substitute the administrator to the owner of the software, who can accept it or reject it at his or her discretion. In case of acceptance, the owner of the software shall appoint a new administrator.

There are no limits to the number of consecutive terms that a single member can serve in the Steering Group.

The minutes of the meetings, the proceedings and the composition of the Steering Group shall be made public in an ad hocsection of the website.

 

5.1. Temporary rule

 

For the three-year period 2009-2011, for the purposes of launching the Ornitho.it system, the Steering Group shall be composed as follows:

Representatives of national associations: Pierandrea Brichetti (CISO), Claudio Celada (LIPU), Luciano Ruggieri (EBN Italia)Representative of ISPRA: Fernando SpinaRepresentatives of regional associations: Giovanni Boano (on behalf of GPSO), Maurizio Fraissinet (on behalf of ASOIM), Luca Puglisi (on behalf of COT), Roberto Tinarelli (on behalf of ASOER). 

Technical administrator: Roberto Lardelli (Vogelwarte Sempach)

Appointed members: during the preliminary meetings that led up to the establishment of the first Steering Group, it was agreed that Giuseppe Bogliani (on behalf of University of Pavia) and Paolo Pedrini (on behalf of MTSN) should be appointed to the Steering Group.


6. Adhesion to Ornitho.it on the part of associations and groups

Along with the founding associations (national associations: CISO, EBN Italia, LIPU; regional associations: As.Fa.Ve, ASOER, ASOIM, COT, Ficedula, GOS, GPSO, SROPU), adhesion on the part of additional associations or groups is possible after filing a request with the Steering Group, which can approve the request with a 2/3 majority. The adhering associations undertake to contribute financially to Ornitho.it according to the modalities established by the Steering Group, and participate in the nomination of the 4 representatives of the regional associations in the Steering Group at the beginning of the following three-year term.

The associations or groups that contribute financially to Ornitho.it are guaranteed equal visibility on the website, in accordance with the modalities established by the Steering Group.

The associations adhering to Ornitho.it, and which already have significant historical databases that can wholly or partly be assimilated into Ornitho.it shall identify the best ways in which such data can be shared in a reciprocally advantageous manner.

Ornitho.it shall be allowed to exchange data with other existing ornithological databases; such exchanges of data shall be regulated by specific agreements.

 

7. Membership of the Data Verification Group


The members of the Data Verification group shall be appointed by the Steering Group on the basis of their specific and regional areas of expertise. There is no limit to the number of members of the group. The number of reviewers shall be determined by the Steering Group in order to optimize the system’s functioning. In case of disagreement between the members of the Steering Group, the nomination or revocation of reviewers shall require a simple majority. There are no time limits to the terms of individual members of the Data Verification Group. Nevertheless, their appointment can be revoked at any time by the Steering Group, which shall provide grounds for dismissal.

The membership of the Data Validation Group and the specific competences of each member shall be made public in an ad hoc section of the website.

 

8. Software ownership


The ornitho.it software is the property of Gaëtan Delaloye, Biolovision Sàrl, Ardon, Switzerland


9. Server rental costs


The parties supporting Ornitho.it shall cover the costs of renting the server that hosts the system (through Gaëtan Delaloye, Biolovision Sàrl, Ardon) according to an ad hoc agreement. The repartitioning of the costs is determined by the Steering Group. Server rental costs can also be covered by donations from parties not formally adhering to Ornitho.it.

 

9.1. Temporary rule

 

For the first year of operation, starting from the official launch date of the definitive version of Ornitho.it, server rental costs shall be repartitioned as follows: LIPU 2500 Euros, CISO 500 Euros, EBN 500 Euros, regional groups/associations (As.Fa.Ve, ASOER, ASOIM, COT, Ficedula, GOS, GPSO, SROPU): 200 Euros each (for a total of 1600 Euros).

Total guaranteed funding for the first year: 5100 Euros.


10. Administration


Roberto Lardelli (Vogelwarte) and Gaëtan Delaloye, Biolovision Sàrl, Ardon shall be in charge of the administration (technical management) of Ornitho.it.

 

11. Privacy

 

Ornitho.it is subject to Italian privacy laws. Registered users are asked to sign the release form.



12. Changes to the Regulations

 

Any changes to the present regulations must be approved by the Steering Group with a two-thirds majority, with the exception of the composition of the Steering Group, which requires a unanimous decision (see article 5).

           

 

13. Cessation of Ornitho.it

 

In case of cessation of Ornitho.it, registered users shall be informed with at least three months’ prior notice, in order to allow each one to recover his or her data. The general database shall be entrusted to a non-profit association to be appointed by the Steering Group; this association shall undertake to: A) preserve the database; B) prevent anyone from using the data without prior authorization from its individual owners for twenty years following the cessation of Ornitho.it; C) after twenty years, make the data publically available to all, free of charge.
